Welcome to the ECC’s website. The ECC provides website features to you subject to the following terms and conditions. If you visit or shop on this ECC website, you accept these terms and conditions. Please read them carefully.

PRIVACY
This privacy notice applies to personal and other information collected on the ECC’s website: www.ecc.org.nz.
Personal and Centre information is collected by the ECC about its members. This information is a mix of information obtained from public sources (eg: the Ministry of Education) and information supplied by the member. Information is also obtained about other licensed early childhood education centres that are not members of the ECC. This information is obtained from public sources only.
All information is reviewed monthly for accuracy and completeness by the ECC.
The information is used by the ECC to respond to information and advice requests; advising members and other of important issues faced by the sector; opportunities that may help members to operate more efficiently or effectively; and in order to construct a statistical and demographic profile of the early childhood education sector that can assist us in advocating on behalf of our members.
You can choose not to provide certain information, and our members can chose who can access the contact details of our members.
We share ECC Members’ contact information only to our preferred suppliers, with whom we have a contractual arrangement. This is in order for them to contact you to let you know about the various special benefits they offer ECC members and how to take advantage of them.
Other than as set out above, you will receive notice when information about you might go to third parties, and you will have an opportunity to choose not to share the information.
We do not collect users’ IP addresses or employ the use of cookies.
You have the right to request access to or correction of personal or centre information held by the ECC. To do this, contact the ECC at the address given at the end of this section.
COPYRIGHT
All material on the ECC website is protected by copyright; and anyone can utilise any of the material available on the website free of charge and without permission of the ECC provided that the source and copyright status of the material is acknowledged.
All material on the restricted section of the ECC website is accessible by financial members of the ECC only and cannot be utilised, downloaded, copied or printed by anyone who is not a financial member of the ECC without the permission of the ECC.
Altering any of the content of the ECC website by a member is done at the member’s own risk. The ECC accepts no liability for content that is downloaded and altered.
LICENSE AND SITE ACCESS
The ECC grants access to financial members of the ECC to certain sections of its website that are restricted and require password entry. ECC members have unlimited access to these sections so long as their financial membership remains valid under the terms of the ECC’s Constitution and Membership Policies.
ECC financial members accept the obligation not to share access to the restricted sections of the ECC’s website with anyone else.
YOUR ACCOUNT
If you use this site, as an ECC Member you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. The ECC does sell products that you can purchase with a credit card or other permitted payment method. The ECC reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
NAME TO APPEAR ON YOUR / CARDHOLDER’S STATEMENT
The name that will appear on your / the cardholder’s statement in relation to any purchase made for products, services or events arranged through the ECC’s website will be: “Early Childhood Council”.
REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT
ECC Members may, after logging on, post reviews, comments, photos, and other content; send communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of content. The ECC reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.
RETURNS, REFUNDS AND TITLE
The ECC does not take title to returned items until the item arrives at our National Office. At our discretion, a refund may be issued without requiring a return. In this situation, the ECC does not take title to the refunded item.
Any item sold through the ECC’s website may be returned to the ECC by the purchaser within 10 (ten) working days of purchase for any reason. The purchaser is entitled to a refund of the purchase price of the item, not including courier or postal charges, only after the returned item has been received at the ECC’s National Office. The item must be in a fit-for-sale condition for the ECC to accept its return.
Any item received by the purchaser in a damaged state, or in error, may be returned for full refund. In such a situation, the purchaser must contact the ECC’s National Office by phone or e-mail immediately or before the end of the next working day.
Any event registration may be cancelled up to one week before the event is scheduled to take place. A full refund applies. Applications for refunds for event registrations within a week of the event will be considered on a case-by-case basis. Events include the ECC’s Annual Conference, ECC-endorsed Workshops, Seminars and Webinars.
PRICING
Except where noted otherwise, the List Price displayed for products and events on our website represents the full retail price listed on the product or event itself.
With respect to items sold by the ECC, we cannot confirm the price of an item until you order; however, we do NOT charge your credit card until after your order has entered the shipping process. Despite our best efforts, a small number of the items in our catalogue may be mispriced. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.
Please note that this policy applies only to products sold and shipped by the ECC.
All items, products, services and events available for sale on this website are listed in New Zealand dollars ($NZ). Goods and Services Tax applies to all sales and will be listed separately on your invoice/statement.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
The information, tools, templates and opinions contained in this site are provided for convenience as part of the service we offer ECC members at this web site. However, the ECC cannot accept any liability for its accuracy or content. Visitors who rely on this information do so at their own risk.
SITE POLICIES, MODIFICATION, AND SEVERABILITY
We reserve the right to make changes to these Terms and Conditions at any time. If any of these terms and conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
COMPLIANCE WITH LAW
Nothing in these Terms and Conditions is intended to avoid the provisions of the New Zealand Consumer Guarantees Act 1993 (“CGA”) except to the extent permitted by the CGA or to exclude liability arising under any other statute. If and to the extent that such liability cannot be lawfully excluded, these Terms and Conditions shall be modified to the extent necessary to give effect to the above intention. If you are acquiring goods or services from us for the purposes of a business, you agree that the guarantees provided in the CGA shall not apply. We do not provide any express guarantees (as that term is defined in the CGA) other than those expressly confirmed in these Terms.
You consent to receive communications from us electronically and agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You agree to be bound by any agreement reached through electronic communications in terms of the Electronic Transactions Act 2002. You consent to receiving electronic messages and information sent by us (or on our behalf) for any purposes described in our Privacy Policy. You agree, pursuant to section 11(2) of the Unsolicited Electronic Messages Act 2007, that the person sending any such message need not include a functional unsubscribe facility in that message.
This website and these Terms and Conditions shall be governed by, and construed in accordance with, the laws of New Zealand and the courts of New Zealand shall have non-exclusive jurisdiction to hear and determine any dispute arising in relation to this website or these Terms. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New Zealand and agree that the courts of New Zealand are a convenient forum in which to resolve any dispute arising in relation to this website or these Terms.
The information contained on this website has been prepared in accordance with New Zealand law and may not satisfy the laws of any other country. We make no representations, warranties, or guarantees as to whether or not the information or products available from this website are appropriate or available for use in other countries. If you choose to access this website from outside New Zealand, you are responsible for compliance with applicable local law.
